BREAKING: The Indiana Supreme Court has agreed to take on the Old Y Case

The Indiana Supreme Court breathed new life into the City of Marion’s lawsuit in the “Old YMCA” case Thursday when the court said it would hear arguments on why the litigation ought to continue.

The suit against several defendants was originally filed four years ago and has moved through trial court and state court of appeals without resolution. The city appealed to the Supreme Court in June and, in a decision filed Thursday afternoon said it will grant the city a hearing and presentation of oral arguments.

No date has yet been set for the hearing.

Defendants in the suit are the London Witte  Group consultants; Chad Seybold, a contractor and brother of former Mayor Wayne Seybold; and the estate of the late Michael An, the developer of the failed $3 million renovation project dating back to 2009.
